Terms of Service

These Terms govern your use of Name the Hue (the "Service"), operated by Nicholas Pierides ("we", "us"). By using the Service or subscribing to Name the Hue Pro, you agree to these Terms. If you do not agree, please don't use the Service.

1. The Service

Name the Hue is a daily colour-guessing game. The core daily puzzle is free to play. Some features are offered as a paid subscription ("Name the Hue Pro"), described below. We may change, add, or remove features over time.

2. Accounts

You can play without an account, but signing in lets us save your stats across devices and is required for Name the Hue Pro. You are responsible for keeping your login secure and for activity under your account. You must provide an email address you control, and you must be old enough to form a binding contract in your country.

3. Name the Hue Pro subscription

• Billing. Name the Hue Pro is a recurring subscription billed in advance at the price and interval shown at checkout. Payments are processed by Stripe; we do not receive or store your full card details.
• Auto-renewal. Your subscription renews automatically each period until you cancel. Each renewal charges your saved payment method.
• Price changes. We may change the price; any change applies from your next renewal, and we'll give reasonable notice.
• Complimentary access. We may grant Pro to certain accounts for free at our discretion; this can be withdrawn at any time.

4. Cancellations & refunds

• Cancel anytime. You can cancel from Settings → Name the Hue Pro → Manage, which opens the Stripe billing portal. Cancellation stops future renewals; your Pro access continues until the end of the period you've already paid for.
• Refunds. Payments are generally non-refundable except where required by law. If you were charged in error or believe there's a genuine problem, contact us within 14 days of the charge and we'll consider a refund in good faith.
• Statutory rights. Nothing here removes any refund or cancellation rights you have under the consumer law of your country.

5. Acceptable use

Don't misuse the Service: no attempting to break, overload, or gain unauthorised access to it; no automated abuse; and no using it unlawfully. We may suspend accounts that do.

6. Intellectual property

The Name the Hue brand, design, and code are ours. Colour names are from the XKCD colour survey and are public domain (CC0).

7. Disclaimers

The Service is provided "as is", without warranties of any kind. We don't guarantee it will always be available, uninterrupted, or error-free.

8. Limitation of liability

To the extent permitted by law, our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses.

9. Changes to these Terms

We may update these Terms; material changes will be reflected by the "last updated" date above, and continued use means you accept them.

10. Governing law

These Terms are governed by the laws of Victoria, Australia, and the courts there have jurisdiction. Nothing in these Terms limits your rights under the Australian Consumer Law, which cannot be excluded.
